1. Agreement and Updates

Welcome to InstaSVG. By accessing or using our AI-powered vector graphics generation service, you agree to be bound by these Terms of Service. Please read these terms carefully before using our service.

By creating an account, accessing, or using InstaSVG, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use our service.

We reserve the right to modify these terms at any time. Continued use of the service after changes constitutes acceptance of the modified terms.

2. Eligibility and Account Access

2.1 Eligibility

To use InstaSVG, you must:

• Be at least 13 years of age
• Have the legal capacity to enter into binding contracts
• Not be prohibited from using the service under applicable laws
• Provide accurate and complete registration information
• Maintain the security of your account credentials

2.2 Account Registration

When you create an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

You are solely responsible for maintaining the confidentiality of your account and password. We are not liable for any loss or damage arising from your failure to protect your account information.

3. Description of the Service

InstaSVG is an AI-powered platform that generates scalable vector graphics (SVG files) from text prompts or uploaded images. The service provides:

• AI-powered vector graphics generation in multiple artistic styles
• Text-to-vector and image-to-vector conversion capabilities
• Digital delivery of generated SVG files
• Account management and content storage features
• Public gallery and sharing options (optional)

All services are delivered digitally through our web application. No physical products or shipping are involved.

4. Usage Credits, Plans, and Billing

4.1 Credits

InstaSVG uses a usage-based credit model to operate its services. Each eligible generation action consumes one (1) credit from your available balance. Credit allocations depend on your selected plan and are refreshed at the start of each billing cycle.

Credits are tied to the applicable billing period and expire at the end of that period unless otherwise stated. Credits have no cash value and cannot be transferred, exchanged, or redeemed.

4.2 Billing and Payments

Subscription charges are collected in advance and recur automatically unless canceled. By subscribing, you authorize InstaSVG to charge your selected payment method on a recurring basis via our payment processor.

If a payment attempt fails, access to paid features may be limited or suspended until payment is successfully processed. Except where required by law, fees are non-refundable.

4.3 Cancellation

You may discontinue your subscription at any time through your account dashboard. Your plan will remain active through the end of the current billing cycle, after which renewal will stop.

5. Permitted and Prohibited Uses

You agree to use InstaSVG responsibly and in accordance with applicable laws. The following activities are not permitted:

• Using the service to produce or distribute content that violates intellectual property or privacy rights
• Generating material that is unlawful, exploitative, or intended to harm others
• Attempting to bypass technical safeguards, access restrictions, or usage limits
• Automating access or scraping without explicit authorization
• Using the platform to mislead, impersonate, or defraud
• Use the Service to create or reproduce identifiable likenesses of real individuals for deceptive, impersonation, or unauthorized purposes
• Offering InstaSVG services, credits, or outputs for resale without permission

We reserve the right to determine whether usage violates these guidelines and to take appropriate action, including content removal or account suspension.

6. Content Ownership and Licensing

6.1 Your Inputs

You retain all rights to prompts, source images, and other materials you submit to InstaSVG. You grant InstaSVG a limited, temporary license to process this material solely for the purpose of operating and improving the service.

6.2 Output Ownership

Subject to your compliance with these Terms, InstaSVG assigns to you all rights, title, and interest in the SVG output generated for your account. You may use generated files for personal or commercial purposes.

You acknowledge that AI-generated content may resemble existing works and that InstaSVG does not guarantee originality or exclusivity. You are solely responsible for evaluating whether your use of any generated output infringes third-party rights (see our Trademark Policy).

6.3 Public Sharing

If you choose to make generated content publicly visible, you grant InstaSVG a non-exclusive, worldwide, royalty-free license to display that content within the platform and related promotional materials. You may revoke public visibility at any time.

6.4 Platform Materials

All software, interfaces, workflows, branding, and system components of InstaSVG remain our exclusive property and may not be copied, reverse-engineered, or reused without prior written consent.

7. Enforcement, Moderation, and Restrictions

We reserve the right to:

• Monitor content generated and shared on our platform
• Remove content that violates these terms or applicable laws
• Suspend or terminate accounts for policy violations
• Report illegal activity to law enforcement
• Restrict access to features or services for users who violate these terms

8. Artificial Intelligence Disclaimers

8.1 AI Limitations

InstaSVG relies on machine-learning systems that generate outputs probabilistically based on user input. As a result, outputs may contain errors, unexpected elements, or similarities to existing works. We do not warrant that generated content will meet specific aesthetic, legal, or technical requirements.

You are responsible for reviewing, validating, and determining the suitability of generated content before use.

8.2 Third-Party Rights

You are solely responsible for ensuring your use of generated content does not infringe third-party intellectual property rights. We do not verify whether generated content infringes trademarks, copyrights, or other rights.

8.3 AI Training and Data Usage

InstaSVG does not use private user content to train public AI models unless explicitly disclosed. Content marked as private remains inaccessible to other users and is processed only as necessary to deliver the service.

9. Service Availability and Changes

InstaSVG is provided "as is" without warranties of any kind. We do not guarantee uninterrupted, error-free, or secure service. We reserve the right to:

• Modify, suspend, or discontinue the service at any time
• Update features, functionality, or user interfaces
• Implement maintenance windows that may temporarily limit access
• Change pricing, plans, or credit allocations with reasonable notice

10. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid in the last 12 months
• We are not liable for losses resulting from unauthorized account access
• We are not responsible for third-party content or services

11. Indemnification

You agree to indemnify and hold harmless InstaSVG, its affiliates, and their respective officers, directors, and employees from any claims, damages, losses, or expenses arising from: (a) your use of the service; (b) your violation of these terms; (c) your violation of third-party rights; or (d) any content you generate or share.

12. Account Suspension and Termination

We may restrict, suspend, or terminate access to InstaSVG at our discretion if we believe your use presents legal risk, violates these Terms, or harms the integrity of the service. Termination may occur with or without prior notice, subject to applicable law.

Following termination, access to the service will cease immediately. You may request a copy of your stored data within thirty (30) days, after which it may be permanently deleted.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.

14. General Legal Provisions

• Entire Agreement: These terms constitute the entire agreement between you and InstaSVG
• Severability: If any provision is invalid, the remaining provisions remain in effect
• Waiver: Failure to enforce any right does not constitute a waiver
• Assignment: You may not assign these terms without our consent
• Force Majeure: We are not liable for delays due to circumstances beyond our control
