3. User Responsibilities

You are solely responsible for determining whether content generated, downloaded, modified, or distributed through InstaSVG implicates trademark rights.

This responsibility applies to:

• Content generated from descriptive or brand-related prompts
• Images uploaded that contain brand identifiers or logos
• Files downloaded from public or shared areas of the platform
• Modified or derivative works created using generated output
• Both commercial and non-commercial uses

You must ensure that your use of any content complies with applicable trademark laws in all relevant jurisdictions.

4. Prohibited Trademark-Related Activities

You may not use InstaSVG to engage in activities that infringe, dilute, or misappropriate trademark rights, including but not limited to:

• Creating counterfeit or imitation brand materials
• Producing content that falsely suggests affiliation, sponsorship, or endorsement
• Misleading consumers regarding the origin or source of goods or services
• Generating branded assets for unauthorized merchandise or resale
• Supporting unfair competition, passing off, or trade dress infringement

InstaSVG reserves the right to restrict access or take enforcement action where such use is identified.

5. Public Content and Downloads

Some platform features allow users to publish content publicly. Publicly available content may contain elements that resemble trademarks.

Downloading or using public content does not grant permission to use any trademarks depicted. Users are responsible for reviewing downloaded files and removing or modifying trademarked elements where necessary before use.

6. Fair Use and Legal Exceptions

Certain limited uses of trademarks may be permitted under applicable law, such as nominative use, parody, commentary, or educational reference. The availability and scope of these exceptions vary by jurisdiction and context.

InstaSVG does not determine whether a particular use qualifies as fair use and does not provide legal advice. Users should consult qualified legal counsel before relying on any legal exception.

7. Platform Limitations

InstaSVG does not:

• Review or screen generated content for trademark clearance
• Maintain a registry of protected trademarks
• Conduct trademark searches or availability checks
• Provide opinions on trademark validity or enforceability
• Guarantee that generated content is free of trademark issues

All outputs are provided as-is and require independent review before use.

8. Enforcement and Repeat Infringement

InstaSVG may take action in response to trademark-related complaints or violations, including warnings, content removal, account suspension, or termination.

Accounts associated with repeated trademark violations may be permanently disabled and restricted from future access.

9. Reporting Trademark Concerns

Trademark owners or authorized representatives may submit infringement reports by providing sufficient information to identify the trademark and the allegedly infringing content.

Reports should include:

• Identification of the trademark at issue
• Jurisdiction or registration details, if applicable
• Description and location of the infringing content
• Contact information and authority to act
